Clarification Text on the Law on the Protection of Your Personal Data

Falez Group (Data Controller), by taking into account the security of our valued users, in order to protect fundamental rights and freedoms, with the right of privacy coming first, within the scope of our obligation to inform in accordance with the Law on the Protection of Personal Data* (“Law”) regulated related to personal data;

In accordance with the Law, your personal data are recorded and stored for the establishment of a service relationship as Data controller and Data processor, ensuring service continuity, performing our services, and also in accordance with the responsibilities arising from other laws as a company.

In this context, in the capacity of Data Controller, regarding the personal information within the framework described in the Law, will be able to obtain, record, preserve, be able to update in order to continue the contractual relationship, reorganize, disclose, assign, transfer, and share personal information to third parties in cases and to the extent permitted by the relevant legislation and process it in other ways listed in the Law.

Your personal data includes data and information that can directly or indirectly identify a person such as, but not limited to, your name, surname, date of birth, place of birth, home address, T.R. ID number, Tax Office and Tax Number, driving license serial number, ID serial number, phone numbers, motor vehicle number plate, passport number, cv, photographs, images and voice recordings, fingerprints, retinal scans, IP address, e-mail address, hobbies, people you interact with, group memberships, family information, health information and records, medical data, x-rays, your health institution records such as MRI, blood group, country-city-postal code, age, gender, criminal record, bank account number, academic information, marital status, information about your children, emergency information, disability status, military service records, monthly premium and service certificate, payrolls. 

Your personal data are processed for purposes such as recruitment, performance evaluation, creation and storage of the personal file, execution of gate interviews processes and other internal operational activities within the scope of planning and execution of human resources processes of our Company and ensuring security within and out of the company. In addition, our company processes, stores and transfers personal data and sensitive personal data that it considers necessary in order to provide the best service and product that it aims to provide, as well as the information that our company is obliged to receive from its customers and the authorities assigned by its customers, to the extent permitted by legal regulations. Our company receives personal data from real persons within the scope of supporting services, purchase and sale (execution of commercial relations). For the persons from whom our company receives support, real persons with whom the company has commercial relations for the continuity of the company, real persons from whom the company is obliged to receive services as required by law, and both candidates for employment and working personnel;

Your personal data may be processed, stored, transferred to the extent stipulated by law, and deleted or destroyed at the end of the periods determined by the law in order to be submitted to the Local Law Enforcement Forces and the Organized Industrial Directorate upon request.

In addition, our Company may also process your personal data for other purposes specified in Articles 5 and 6 of the PDP Law and provided that it is limited to these data processing conditions.

Sensitive personal data refers to data relating to race, ethnic origin, political opinions, philosophical beliefs, religion, sect or other beliefs, appearance, association, foundation or syndicate membership, health, sexual life, data of criminal convictions and security measures, and biometric and genetic data.

As a rule, our company does not request and process sensitive data from its users, however, information and data that are mandatory for registration in accordance with the policies of third parties and organizations may be recorded, limited to this, if it provides sensitive personal data. For example; If your identity sample requested for documented fieldnames contains the “religion” digit and your religious belief is included, even if the purpose is not to record your sensitive data, it may be within the scope of sensitive data due to the document it is located.

Your personal data may be shared to the extent necessary with the persons, institutions and organizations and other third parties permitted by the provisions of the legislation and in the domain name registration information which is limited to the information that the domain name registration authorities require to be publicly available; with our direct or indirect domestic, foreign subsidiaries and legal units, financial advisors that we receive service from, experts and doctors within the scope of occupational health and safety and consultants and organizations that we work with and cooperate with, such as our call center, in order to carry out our company activities.

Without prejudice to the cases stipulated in Article 28 of the Law titled Exceptions, your rights that you may exercise by applying to our Company within the framework of Article 11 of the Law are as follows:

To learn whether your personal data is being processed,

Request information if your personal data has been processed,

To learn the purpose of processing your personal data and whether they are used in accordance with their purpose,

To know the information related to the third parties to whom your personal data is transferred domestically or abroad,

To request correction of your personal data in case of an incomplete or incorrect processing, to request the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of the Law,

To request notification of the transactions made pursuant to (d) and (e) above to third parties to whom your personal data have been transferred,

Object to the occurrence of a result to your detriment by analyzing your processed data exclusively through automated systems,

In case you suffer damage due to unlawful processing of your personal data, to demand compensation for your damage.

It is possible to submit your rights and other requests regarding the implementation of the PDP Law to the Human Resources Department of our Company in writing or by other methods to be determined by the Personal Data Protection Board. Our Company will finalize your requests within this scope free of charge as soon as possible and within thirty days at the latest, depending on the nature of the request. We would like to state that we reserve the right to request the expenses to be incurred by our Company in order to fulfill your requests according to the tariff specified in Article 13 of the Law titled Application to the Data Controller.
